The website user acknowledges having the necessary skills and resources to access and use this site.

The website user acknowledges having verified that the computer configuration used contains no viruses and is in perfect working order.

The user also acknowledges having read these general terms of use of the website and agrees to comply with them without reservation.

FLEXINA positions itself as a company specializing in architecture, design and development of e-business applications designed using modern web technologies.

The FLEXINA website offers a description of its products but it essentially constitutes an e-business platform that allows the acquisition of usage rights (non-exclusive and non-transferable license) of certain FLEXINA software (hereinafter the "services").

Simple consultation of the website is free and does not require any prior registration.

These general terms of use of the website apply to all users of the site.
If a provision of these conditions applies only to individuals or professionals, mention is made of it.

For professionals, these Terms exclude the application of any other general conditions. In the event that the site user opts for the online acquisition of a FLEXINA software usage license, the FLEXINA ASP agreement also applies, but on a subsidiary basis, for matters not addressed or partially addressed by these conditions.

All modifications to these Terms must be accepted in writing.

FLEXINA implements appropriate means to ensure the availability of information and services accessible on its site but cannot be held responsible for any lack of availability of information and services or the presence of viruses on its site.

Any order for services is considered as a customer's offer to purchase services, in accordance with these Terms.

FLEXINA accepts this offer under these conditions from the moment it confirms the order by email. When finalizing the service order made online, the customer is first invited to explicitly agree to these Terms and the ASP agreement mentioned in Article 2.

Without this express online agreement and without order confirmation by FLEXINA, the parties are not bound by any contract.

FLEXINA has the absolute right to refuse to confirm an order for any reason it deems reasonable.

Unless otherwise specified in writing, the software usage license is acquired for a period of 3, 6 or 12 months.

30 days before expiry, FLEXINA invites the customer by email to decide on renewal.

In the absence of customer response before expiry, the license is not tacitly renewed.

Under Belgian law and European Consumer Rights Directive 2011/83/EU, individuals have the right to cancel their initial order without reason and without charge within 14 calendar days following the confirmation email sent by FLEXINA.

In this case, the refund will be made in full and as soon as possible.

The right of withdrawal stated above does not apply to professionals as it is carried out within the framework of a B2B transaction.

The price of services is mentioned in FLEXINA's offer and order confirmation.

The price to be paid by professionals does not include VAT but may be added to certain taxes and/or other fees necessary for the acquisition of services.

FLEXINA very precisely mentions the various elements that make up the price in the online acquisition process.

Unless otherwise agreed in writing, no service is provided by FLEXINA before payment is made.

Professionals receive an invoice sent by post when they request it by email at info@flexina.co.

Otherwise, the invoice is sent to them by Internet in email format.

In case they discover an error or anomaly in the order confirmation and/or invoice compared to their order, customers are required to contact FLEXINA directly.

FLEXINA implements appropriate means to make its site available but cannot be held responsible for errors, lack of availability of information and/or the presence of viruses on its site.

FLEXINA PROVIDES NO WARRANTY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF OWNERSHIP OR NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) FOR THE ACCESSIBILITY, ACCURACY, RELIABILITY, UPDATES OR CONTENT OF THE SITE PAGES. FLEXINA CANNOT, UNDER ANY CIRCUMSTANCES, BE HELD LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR BUSINESS INTERRUPTION, RESULTING FROM THE USE OR INABILITY TO USE THIS SERVICE, EVEN IF THE USER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE EXCLUSION OR LIMITATION OF LIABILITY FOR INDIRECT OR INCIDENTAL DAMAGES IS NOT VALID UNDER THE LEGAL OR REGULATORY RULES IN FORCE IN CERTAIN COUNTRIES AND THIS EXCLUSION MAY THEREFORE NOT APPLY. IF THIS IS THE CASE, FLEXINA'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

FLEXINA cannot be held liable for any damage whatsoever, direct or indirect, resulting from the use of its services, even if the possibility of such damage has been reported. In particular, the following are excluded from any warranty: loss of enjoyment of services, loss of data, loss of earnings and increase in costs and expenses, including file reconstruction costs, operating losses, market losses, etc.

FLEXINA's liability in the event of damage for any cause whatsoever and whatever its basis (contractual or tort) is expressly limited to the amount of the fee paid by the customer to benefit from the usage license of the services.

FLEXINA makes every effort to perform services in a timely manner.

When no response time has been set, a period of 15 days applies.

FLEXINA cannot be held liable for direct and indirect damages resulting from FLEXINA's inability to perform services in a timely manner.

FLEXINA is the holder of all intellectual property rights relating to the services, content and configuration of the site as well as the domain name.

As a reminder, regarding services (the software usage license), the provisions of the ASP agreement relating to the protection of intellectual property rights apply in full.

FLEXINA collects, uses and disseminates personal data relating to the customer or their employees in accordance with Belgian legislation and FLEXINA's Privacy Policy.

Each party, as well as their employees and subcontractors, is required to treat and use all information received from the other party with complete confidentiality and, in any case, within the strict framework of carrying out their obligations.

Under no circumstances, except those required by law, may this information be communicated to third parties.

These Terms have been drafted in accordance with Belgian legislation and are regularly updated. If a clause of these Terms proves to be non-compliant with Belgian consumer protection legislation, the latter shall prevail.

These general terms of use of the FLEXINA website may be unilaterally modified by FLEXINA and are immediately applicable upon their publication on the site. Users are required to regularly check the publication of any new versions.

These terms and any contractual link formed between FLEXINA and the site user are subject to Belgian law and in case of dispute to the jurisdiction of the competent courts of the judicial district of Liège.
