When will electronic invoicing be mandatory in Belgium for public contracts?

In Belgium, the royal decree of March 9, 2022 makes electronic invoicing mandatory for public contracts and concessions.

This means that if you work for the state, administrations, municipalities, public hospitals... you must send your invoices in electronic format.

The application dates of this decree are May 1, 2023 for invoices from €30,000 excluding VAT and from November 1, 2023 for invoices below €30,000.

How to send an electronic invoice to Belgian administrations?

You have three possibilities:

• You can upload a PDF file to the Mercurius portal and then manually encode a form with all the invoice information. This method is strongly discouraged because you will encode your invoice twice, it takes time and creates risks of errors when entering data.
• You can become a Peppol access point, pass certification, generate invoice files in UBL format and transmit them yourself via the Peppol network. This method is complex and only possible for large companies with an IT department dedicated to invoicing.
